Abstract

“Air pollution is turning Mother Nature prematurely gray.” ~ Irv Kupcinet

As India grapples with mounting concerns over air pollution and environmental degradation, the need for a comprehensive and effective legal framework has become increasingly evident. This research paper delves into the intricacies of India's legal framework for air pollution control and environmental protection. It explores the historical development of air quality laws, highlighting their evolution and the challenges they seek to address. The paper examines key legislative instruments and assesses crucial legal tools, such as the Air (Prevention and Control of Pollution) Act,1981, and The Environment (Protection) Act,1986, delving into their purposes and clauses. Additionally, the investigation explores the responsibilities and operations of regulatory entities like the Central Pollution Control Board  and State Pollution Control Boards  in the implementation of air quality directives. It scrutinizes the mechanisms in place for monitoring air quality and the utilization of real-time data for informed decision-making and public awareness. The study assesses the compliance mechanisms and penalties associated with air quality regulations, while also exploring successful enforcement initiatives and identifying persistent challenges.  Additionally, the paper discusses India's participation in international agreements related to air quality and the influence of these agreements on its air pollution control strategies. It presents a comprehensive analysis of the strategies, challenges, and opportunities within India's complex legal framework for air pollution control and environmental protection. Ultimately, this research paper contributes to a deeper understanding of the legal mechanisms in place to clear India's skies of pollution and protect the environment and public health. It offers valuable insights for policymakers, environmentalists, and researchers seeking to navigate this intricate maze and further strengthen air pollution control efforts in India.
